Effective date: 2026-10-15

These terms and conditions apply to the Uchiwa Maker (うちわ文字作成) app for iOS, together with any related services operated by Anton Ryskalev (collectively, the "Application"). Anton Ryskalev is hereby referred to as the "Service Provider".

By downloading or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application.

License to use the Application

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on Apple devices that you own or control, for personal use. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as and only to the extent that such activity is expressly permitted by applicable law.

The Application is licensed to you, not sold. Apple's Licensed Application End User License Agreement (the "Standard EULA") also applies to your use of the Application. These Terms supplement the Standard EULA.

Intellectual Property

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, trade names, logos, and branding. Nothing in these Terms grants you any right to use the Service Provider's trademarks, logos, or branding.

The Application includes third-party materials that are provided under their own licenses: fonts from Google Fonts (SIL Open Font License / Apache License 2.0) and stickers from Microsoft Fluent Emoji (MIT License). Your use of those materials is governed by their respective licenses.

Purchases

The Application offers the following in-app purchases:

Prices are shown in the Application before you buy. All purchases are made through your Apple Account and processed by Apple under Apple's terms, including the Standard EULA. Payment, refunds and purchase restoration are handled by Apple. The Service Provider does not see your payment information and cannot issue refunds directly. To request a refund, use Apple's Report a Problem page. To restore purchases, open the Application's settings and tap "購入を復元" (Restore Purchases).

Your Content

Your designs, photos, text and custom stickers are created and stored on your device. The Service Provider does not receive, host, review or publish them.

You are solely responsible for the content you create and use with the Application, including any photos, names, logos, characters or other material belonging to others. You must have the necessary rights or permissions to use such material, and you must not use the Application to create content that infringes the rights of others or violates applicable law.

Venue Rules

Concerts and venues set their own rules for uchiwa and other fan items, such as size limits. Any check provided in the Application is a guide only and is not a guarantee that your uchiwa complies with any rule. It is your responsibility to check and follow the official rules of each concert and venue.

No Affiliation

The Application is not affiliated with, endorsed by, or sponsored by any artists, agencies, or concert organizers. Names of artists, groups or events that you enter in the Application are your own content.

Apple Features

Some features, such as Image Playground, Apple Intelligence and background removal, are provided by Apple's system frameworks and are subject to Apple's terms and device availability. Generated images and phrase suggestions may be inaccurate or unsuitable, and you should review them before use. Font and sticker packs are downloaded from Apple's servers and require an internet connection.

Internet and Device

Some functions of the Application, such as downloading font and sticker packs, require an internet connection. Your mobile network provider's terms still apply, and you are responsible for any data or roaming charges. The Service Provider is not responsible if the Application does not work at full capacity because of a lack of internet access or device storage.

Updates

The Service Provider may update, change, or stop providing the Application or any of its features at any time. The Service Provider does not guarantee that the Application will always be compatible with your device or operating system version. You should accept updates when they are offered.

To the fullest extent permitted by law, the Application is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service Provider does not warrant that the Application will be error-free or uninterrupted, or that printed results will match what you see on screen.

Limitation of Liability

To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, printing costs, or denied entry to a venue, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the total liability of the Service Provider for any claim shall not exceed the amount paid by you for the Application in the 12 months preceding the claim, or the minimum amount that must be paid under applicable law, whichever is greater.

Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict of law rules, except to the extent mandatory consumer protection laws provide otherwise. Nothing in this clause limits any rights you may have to bring a claim in a court that is competent under mandatory law.

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.
